Terms of Sale

These Terms of Sale apply to all orders placed through jacafineart.com. By confirming an order, you confirm that you have read and accepted them.

1. Identity of the seller

The seller is the OBRT identified in the imprint at the bottom of this page, registered in the Croatian Crafts Register under NKD 47.12.0 (retail trade by mail order or internet) and 73.11.0 (advertising agencies / creative work).

The OBRT is not in the Croatian VAT system (Art. 90 (2) of the VAT Act). All prices are final, without VAT.

2. Placing an order

An order is concluded by clicking the 'Place order' button after filling in the checkout. We then send you a confirmation by email with the order details and a unique order number (JC-YYYY-NNNN). The contract is deemed concluded upon dispatch of that confirmation.

The contract is concluded in English, Croatian or German according to your locale. We store the contract text in our database and can forward it on request.

3. Prices and taxes

All prices are stated in euros (€) and are final. The OBRT is not VAT-registered (Art. 90 (2) VAT Act), so VAT is not charged. Shipping cost is displayed before order confirmation and depends on destination and carrier.

4. Payment

Supported payment methods:

• Card (Stripe) — Visa, Mastercard, Maestro, Apple Pay, Google Pay. Stripe handles the payment; we never store card data.
• Cash on Delivery (Hrvatska pošta) — pay the courier on delivery. Limit ≈ €1,500.
• Bank transfer — you receive an email with IBAN, BIC and reference. We dispatch once payment is visible on the account (1–2 working days).

5. Delivery

We ship with Hrvatska pošta and GLS Croatia. Croatia: 2–4 working days; EU: 3–10 working days; rest of world: 5–20 working days. See the full shipping page →

Risk passes to the consumer upon hand-over of the parcel to the consumer (or to a third party designated by the consumer, other than the carrier).

6. Right of withdrawal (30 days)

Under the Consumer Protection Act (Art. 72–79), you have the right to withdraw from this contract within 14 days without giving any reason. JacaFineArt extends this period voluntarily to 30 days from the day you receive the painting.

To withdraw, notify us in writing (email to gbbanusic@gmail.com is sufficient) or use the official withdrawal form available on request.

We refund all payments within 14 days of receiving your withdrawal notice (or later, once the painting reaches the studio), using the same payment method.

The cost of returning the painting is borne by the consumer, except for damaged-in-transit, wrong-item and materially-mis-described returns.

7. Material defects and warranty

The seller is liable for material defects existing at the moment of risk transfer and for defects which appear within 2 years from delivery (Art. 41–53 Consumer Protection Act and the Croatian Obligations Act). You may demand (a) repair, (b) replacement, (c) price reduction, or (d) rescission.

9. Intellectual property

The painter Jasminka Banušić retains all copyright in her works. Purchase of a painting transfers ownership of the physical object only — the buyer does not acquire reproduction, distribution or merchandising rights. The artist retains the right to photograph the work and use those photographs in her portfolio.

10. Disputes

We will attempt to resolve any dispute amicably. Failing that, jurisdiction lies with the materially and territorially competent court in the Republic of Croatia (the Commercial Court in Zagreb).

11. Changes

The seller may amend these Terms. The version in force at the time of the order applies to that order.

12. Effective date

These Terms take effect on the day of publication.
